By using the generative AI tools within VideoScribe, you agree to comply with these terms, which should be read in conjunction with Sparkol's Terms and Conditions and Acceptable Use Policy. If you do not agree with these terms, please discontinue use of the generative AI tools.

1. Purpose of the Generative AI tools

Sparkol provides the AI-powered image generation tools in Beta format for use within VideoScribe. The tool allows you to create images (“Sparkol Content”) to supplement the VideoScribe image library and to enhance your VideoScribe projects (“Project”) with images you generate. This AI tool is not intended for use outside of these contexts.

2. License and Availability

• Limited Usage Rights: Subject to compliance with these terms, Sparkol grants you the right to use the generative AI tools within the scope of your active subscription to VideoScribe. This right expires at the end of your subscription or when the Beta period ends (whichever is sooner).

• Beta Version: The AI image generation tool is in Beta and may be withdrawn or modified at any time without notice. Sparkol makes no guarantees about its availability, performance, or support. As a Beta product, it may contain bugs, errors, or other issues that could affect its functionality.

3. Prohibited Uses

Prohibited Content: You must not use the AI tools to generate or upload images that deliberately infringe on the intellectual property rights or other legal rights of any third party; or that contain:

• Illegal, violent, or hateful content

• Pornographic material

• Any content that is abusive, defamatory, offensive, slanderous, discriminatory, or otherwise unlawful.

You agree that you will not use the AI tool for Training AI or Machine Learning: You must not use the images generated by the AI tool for training other AI or machine learning systems.

• Unlawful Activity: You will not use the tool to create, upload, or share content that is illegal, violates third-party rights, or brings Sparkol into disrepute.

5. Intellectual Property Rights

• Infringement: You must not use the AI tools in a way that infringes on third-party intellectual property rights, including but not limited to copyright, trademark, privacy, or other rights. This includes entering text prompts designed to generate copyrighted, trademarked, or other infringing material.

• Ownership: Other than the limited rights granted to you for accessing and using the generative AI tools and Sparkol Content in accordance with these terms, you will not acquire any title, right, or interest in the Products or Sparkol Content. All such rights are retained by Sparkol or the licensors of any parts of the Products.

6. Support and Feedback

The generative AI tools are provided "as is" during the Beta phase, and Sparkol does not offer support services for Beta products. However, you are encouraged to submit feedback through the available channels, including within the VideoScribe application and support tickets. Your feedback may help improve the tool.

7. Service Availability

While Sparkol will make reasonable efforts to ensure the availability of the generative AI tools, you acknowledge that there may be interruptions due to maintenance or unforeseen issues. We will notify you of scheduled maintenance, but emergency maintenance or events outside our control may cause downtime without prior notice.

8. Limitations on Image Generations

During the Beta phase of the generative AI tool, you are limited to generating a maximum of 250 images. Once this limit is reached, you will no longer be able to generate additional images until the Beta phase ends or unless Sparkol decides to revise this limit. Sparkol reserves the right to modify or revoke this limit at its discretion during the Beta phase.

9. Liability

Sparkol is not liable for any legal or financial consequences that arise from your use of the AI tools, including but not limited to violations of third-party rights, defamation, or unlawful activity.

9. Termination of Access

If you fail to comply with these terms, Sparkol reserves the right to suspend or terminate your access to the generative AI tools at its discretion.
